Terms of Service

These general terms and conditions apply to the use of midl.art, the purchase of artworks, and the initiation of leasing or consulting services through Galerie Midl.

This English version is provided for convenience. The German version (AGB) is the authoritative text.

Contracting party

Your contracting party is Joseph Scheicher, trading as Galerie Midl, Polgarstraße 22/3, Tür 10, 1220 Vienna, Austria. Contact: hi@midl.art.

Offer and conclusion of contract

The presentation of works on the website is not a legally binding offer but an invitation to order or inquire. A purchase contract is concluded when your order is confirmed and accepted at checkout. For leasing, business placements, or special projects, a contract is concluded only through a separate written agreement.

Prices, taxes, and payment

  • The prices and payment terms shown at checkout are decisive.
  • According to the operator, no VAT is currently charged or itemised.
  • Accepted payment methods may include Stripe/credit card, PayPal, and crypto payments, where offered at checkout.
  • For international deliveries, import duties, customs, taxes, or fees may arise in the destination country. These are borne by the customer unless expressly agreed otherwise.
  • Crypto payments are considered complete only once the payment has been sufficiently confirmed by the respective payment provider or network.

Delivery and collection

Purchases are generally possible internationally. Delivery within Vienna is free of charge according to the operator. Shipping outside Vienna is confirmed at checkout or individually. Delivery times depend on the work, packaging, insurance, payment processing, customs, and the logistics partner.

Risk and title pass only after full payment and handover, in accordance with the statutory rules or the terms agreed at checkout.

Digital components and 3D experiences

3D scans, digital twins, videos, NFT or wallet components, and other digital content serve presentation purposes and may technically depend on third-party providers, wallets, blockchains, or hosting infrastructure. The product page, the checkout, and the order confirmation are decisive for what is being purchased.

Midl chat

Midl helps with orientation, advice, and inquiries. Midl’s answers are not binding legal, tax, investment, or authenticity advice. Prices, availability, dimensions, scope of delivery, and contract terms should be verified on the product page, at checkout, in the order confirmation, or in separate agreements.

Cancellation and consumer rights

Consumers may have statutory rights of withdrawal. Details are set out in the cancellation policy. For businesses, rights of withdrawal apply only where expressly agreed or where mandatory law provides for them.

Warranty and liability

Statutory warranty rights apply. With artworks, slight deviations in colour, presentation, on-screen appearance, framing, surface, or scale can be technically unavoidable, provided they do not materially change the agreed performance. Liability for slight negligence is excluded to the extent legally permissible; this does not apply to personal injury or mandatory consumer rights.

Applicable law

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, provided this does not deprive consumers of mandatory protections of the state of their habitual residence.
